Kelly then filed for sole custody of the children so that they could remain in the United States which was denied by the judge. The judge stated that 50/50 custody should be maintained and that the children should stay in France with their father. In 2013, through an extensive custody battle, Rutherford filed for bankruptcy as her net worth had significantly decreased at this point. As of today, Kelly has temporary sole custody over the children, though full custody will still be shared with their father in France.
